Christmas Props Australia – Terms & Conditions  

1. Shipping & Liability

StarTrack’s Role

  • CPA ship via StarTrack. Their terms apply to all deliveries, and we act as intermediaries between you and StarTrack.
  • Key StarTrack Terms Affecting You:
    • Liability Limits: StarTrack’s liability for loss/damage is limited.  Shipping costs charged automatically include Transit Warranty. This is not optional.
    • CPA is not liable for carrier errors.
    • Authority to Leave: StarTrack may leave parcels unattended at the delivery address (e.g., doorstep) if no one is present. Once delivered, the risk transfers to you. (see Unattended Delivery below)
    • Excluded Items: StarTrack excludes liability for fragile items (e.g., glass ornaments), and dangerous goods. Christmas Props Australia will prepare your order and take all reasonable steps to ensure props are securely packaged.
    • Extra Charges (from StarTrack): You may incur fees for:
      • Storage if parcels are uncollected for >2 days.
      • Re-delivery attempts due to incorrect address.
    • Claims Deadlines: Report lost/damaged items to StarTrack within 24 hours (include photos + packaging). StarTrack requires claims within 7–14 days (varies by issue).

2. Pricing & Fees

  • Shipping Costs: Calculated by StarTrack based on weight, cubic size or dimensions (whichever is higher).
  • Price Changes: StarTrack may adjust rates without any notice. We will notify you of increases. If unacceptable, you may cancel orders within 7 days of notice, and only if your shipment has not been passed to Startrack. If you cancel your order a 15% restocking fee may be applied before your refund is returned.

3. Returns & Damages

Australian Consumer Law (ACL)

  • You retain ACL rights (replacements/refunds for major faults).
  • Our Responsibilities: Assist with StarTrack claims but CPA do not guarantee outcomes.
  • Exclusions: No refunds/replacements if:
    • Loss or Damage occurs after unattended delivery (Authority to Leave).

4. Delivery & Storage

  • Unattended Delivery: By default, StarTrack may leave parcels if no one is present at the address of delivery. Contact CPA when placing your order if don’t agree to this and we will mark your shipment so a signature is required.
  • Uncollected Goods: Items uncollected after 60 days may be sold/disposed of by StarTrack.
  • Force Majeure: Delays due to floods, strikes, etc., are not CPA liability.

5. Customer Responsibilities

  • Accurate Details: Provide correct addresses. No refunds for mis-deliveries due to your errors.
  • Packaging: We will securely pack items and use appropriately rigid boxes.
  • Prohibited Items: We do not ship dangerous goods.

6. Governing Law

  • Disputes are governed by Australian Consumer Law and laws of Queensland.

7. Policy Summary

  • CPA is not liable for StarTrack errors, but when appropriate we will assist to resolve issues.
  • You must inspect parcels immediately on delivery and report damage/loss to StarTrack within 24 hours.
  • Extra charges may apply for special handling, storage or re-delivery.
  • Unattended deliveries are at your risk.
